1. Acceptance of Terms
By accessing the website sangareguidedsafari.com, making a booking, or participating in any safari tour operated by Sangare Guided Safari ("the Company", "we", "us", "our"), you ("the Guest", "you", "your") agree to be bound by these Terms and Conditions in their entirety.
If you are booking on behalf of other participants, you take responsibility for ensuring that all members of your party accept these Terms and Conditions. You are also responsible for making all payments due for your booking.
We reserve the right to amend these Terms and Conditions at any time. The version in effect at the time of your booking will apply to your reservation. We recommend reviewing these terms periodically for updates.
These Terms and Conditions are governed by the laws of the Republic of Kenya. Any dispute arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
2. Booking & Reservations
All bookings are subject to availability. A booking is not confirmed until you receive a written confirmation email from us with a booking reference number.
To make a booking, you must be at least 18 years of age and possess the legal capacity to enter into a binding contract. By submitting a booking, you confirm that you meet these requirements.
When you submit a booking through our website, by email, or by phone, you are making an offer to purchase a tour. We may accept or decline this offer at our discretion. A contract between us is formed only when we issue a written booking confirmation.
You must check all details of your booking confirmation carefully and notify us immediately of any errors. We cannot accept responsibility for inaccurate information provided at the time of booking.
If you wish to add additional travelers to an existing booking, you must contact us in writing. Additional travelers are subject to availability and may incur different pricing.
3. Payment Terms
Deposit: A non-refundable deposit of 30% of the total tour cost is required to confirm your booking. Your booking is not confirmed until we receive this deposit and issue written confirmation.
Balance Payment: The remaining balance (70%) must be paid no later than 45 days before the tour start date. If your booking is made within 45 days of departure, full payment is required immediately.
Payment Methods: We accept the following payment methods:
- Bank wire transfer (USD, EUR, GBP, KES)
- Mobile money (M-Pesa)
- Credit card via our secure Stripe payment link (Visa, Mastercard)
- PayPal (subject to additional processing fees)
Late Payments: If payment is not received by the due date, we reserve the right to cancel your booking and retain your deposit. Late payment may also result in price adjustments if exchange rates have changed.
Currency: All prices are quoted in United States Dollars (USD). Payments in other currencies are accepted at the prevailing exchange rate on the date of payment. Bank transfer fees and currency conversion charges are the responsibility of the Guest.
Payment Plans: For bookings made more than 90 days in advance, we offer a three-part payment plan: 30% deposit at booking, 30% at 60 days before departure, and the remaining 40% at 30 days before departure. This option must be requested at the time of booking.
4. Pricing & Inclusions
Included in the tour price:
- Accommodation as specified in the itinerary
- All meals as indicated in the itinerary (full-board where specified)
- Professional English-speaking safari guide for the duration of the tour
- Private 4x4 safari vehicle with pop-up roof for game viewing
- All park entrance fees and conservation levies
- Unlimited bottled drinking water in the safari vehicle
- Airport transfers where specified in the itinerary
- All activities listed in the itinerary
- Government taxes and service charges
Not included in the tour price:
- International and domestic flights
- Visa fees and processing
- Travel insurance (mandatory)
- Vaccinations and medical expenses
- Personal items and souvenirs
- Alcoholic and soft drinks (unless specified)
- Gratuities for guides, drivers, and camp staff
- Optional activities not listed in the itinerary
- Laundry services
- Communications costs (phone, internet)
Price Changes: We reserve the right to correct pricing errors. If a tour is listed at an incorrect price due to a typographical error or system error, we reserve the right to cancel the booking and offer a full refund. We will notify you of any price changes before confirming your booking.
Seasonal Pricing: Some tours may have different pricing depending on the travel season. High season rates apply during peak wildlife viewing periods and holiday periods.
5. Cancellation & Refunds
If you need to cancel your booking, you must notify us in writing by email. The cancellation date is the date we receive your written notice.
Cancellation charges apply as follows:
Refund Processing: Approved refunds will be processed within 14 business days of cancellation approval. Refunds will be made via the original payment method. Bank transfer fees and currency conversion losses are deducted from the refund amount.
No-Show: If you fail to arrive for your tour at the designated time and place, or fail to provide the required documentation, no refund will be given.
Cancellation by Us: We reserve the right to cancel a tour due to insufficient bookings, safety concerns, or circumstances beyond our control. In such cases, we will offer a full refund or alternative tour of comparable standard. We are not liable for any additional costs incurred by you (flights, visas, etc.).
6. Tour Modifications
Changes by Guest: If you wish to modify your booking (dates, tour type, number of travelers), please contact us in writing. Changes are subject to availability and may incur additional charges. Modification requests received within 30 days of departure are treated as cancellations and re-bookings.
Changes by Us: We reserve the right to modify tour itineraries, accommodations, or activities due to weather conditions, road closures, park regulations, safety concerns, or other circumstances beyond our control. We will make reasonable efforts to provide alternatives of comparable standard.
Minor Changes: Minor changes (e.g., alternative lodge within the same category, adjusted daily schedule) do not entitle you to cancel or receive compensation.
Significant Changes: If we make a significant change to your tour (e.g., change of destination, reduction in tour length, change of departure date by more than 7 days), we will notify you as soon as possible and offer the option to accept the change, receive a full refund, or book an alternative tour.
Itinerary Flexibility: Safari itineraries are subject to change based on wildlife movements, weather conditions, and road conditions. Your guide may adjust daily activities to maximize wildlife viewing opportunities. This flexibility is a key feature of safari travel and not grounds for complaint or compensation.
7. Travel Insurance
Mandatory Requirement: Comprehensive travel insurance is mandatory for all guests. You must obtain adequate travel insurance covering the full duration of your tour. Proof of insurance must be provided before the tour start date.
Required Coverage: Your travel insurance must include:
- Emergency medical evacuation (including helicopter evacuation)
- Medical expenses and hospitalization
- Trip cancellation and curtailment
- Repatriation of remains
- Lost or damaged luggage and personal belongings
- Travel delays and missed connections
Recommended Coverage: We strongly recommend additional coverage for:
- Adventure activities (balloon safaris, walking safaris)
- Pre-existing medical conditions
- Trip interruption due to personal reasons
Liability: Sangare Guided Safari is not responsible for any costs incurred due to insufficient travel insurance coverage. You are solely responsible for ensuring your insurance policy meets your needs and the requirements specified above.
Claims: All insurance claims should be directed to your insurance provider. We will provide reasonable documentation to support your claim upon request.
8. Limitation of Liability
Duty of Care: We take our duty of care seriously and will take all reasonable steps to ensure your safety and enjoyment. All our guides are trained in first aid, wildlife safety, and emergency procedures.
Assumption of Risk: Safari travel involves inherent risks including, but not limited to: wildlife encounters, vehicle accidents, road conditions, weather events, and health risks in remote areas. By participating in a safari, you acknowledge and accept these risks.
Limitation: To the maximum extent permitted by law, Sangare Guided Safari shall not be liable for:
- Death, injury, or illness arising from your own actions or negligence
- Illness, injury, or death resulting from insufficient physical fitness
- Loss of or damage to personal property
- Acts of God, natural disasters, or force majeure events
- Government actions, travel restrictions, or border closures
- Third-party service providers (airlines, hotels, transport companies)
- Consequential or indirect losses
Maximum Liability: Our total liability to you for any claim arising from or related to your safari booking shall not exceed the total amount paid by you for the tour.
Third-Party Services: We act as agents for third-party service providers (airlines, hotels, ground transport). Your contract for these services is with the provider directly. We are not liable for their acts, omissions, or failures.
Photography: We may take photographs during the tour for marketing purposes. By participating, you grant us permission to use your image in promotional materials unless you provide written objection.
9. Health & Fitness
Physical Requirements: Safari tours involve game drives in 4x4 vehicles on unpaved roads. Some activities may require walking on uneven terrain. You should be in reasonable physical health to participate fully.
Medical Conditions: You must declare any pre-existing medical conditions, allergies, or disabilities at the time of booking. This information is essential for your safety and will be treated confidentially.
Vaccinations: Consult your travel health clinic or physician before traveling to Kenya or Tanzania. Recommended vaccinations may include yellow fever, typhoid, hepatitis A and B, and cholera. Malaria prophylaxis is strongly recommended.
Altitude: Some destinations may involve altitude changes. If you have heart or respiratory conditions, consult your physician before booking.
Emergency Medical Care: We carry first aid kits in all safari vehicles and our guides are trained in emergency response. However, medical facilities in remote safari areas may be limited. Evacuation to major hospitals may be required in serious emergencies.
Pregnancy: Pregnant women should consult their physician before booking a safari. Some safari activities may not be suitable during pregnancy.
10. Guest Conduct
General Conduct: You agree to behave in a manner that is respectful to fellow guests, staff, guides, and local communities. Disruptive, threatening, or dangerous behavior may result in your removal from the tour without refund.
Wildlife Safety: You must follow all instructions given by your safari guide regarding wildlife viewing. Do not exit the vehicle unless authorized. Maintain safe distances from animals. Do not feed or provoke wildlife.
Park Rules: You must comply with all national park and reserve regulations. This includes speed limits, designated routes, and restricted areas. Violations may result in fines, tour termination, or legal action.
Alcohol & Substances: Excessive alcohol consumption that endangers yourself or others is prohibited. Illegal drug use will result in immediate tour termination and reporting to authorities.
Environmental Responsibility: We operate in pristine natural environments. You must not litter, remove natural objects, or damage vegetation. Follow the "leave no trace" principles.
Cultural Sensitivity: Respect local customs and traditions. Ask permission before photographing local people. Dress modestly when visiting cultural sites or communities.
Smoking: Smoking is prohibited in safari vehicles and enclosed spaces. Designated outdoor smoking areas will be provided at accommodations.
11. Travel Documents
Passport: You must hold a valid passport with at least 6 months validity from the date of entry into Kenya or Tanzania. Ensure your passport has sufficient blank pages for visas and stamps.
Visas: Most nationalities require a visa to enter Kenya and/or Tanzania. Check the latest requirements with the relevant embassy or consulate before travel. E-visas are available for many nationalities.
Yellow Fever Certificate: A yellow fever vaccination certificate may be required if you are arriving from or have transited through a yellow fever endemic country.
Responsibility: It is your responsibility to ensure you have valid travel documents. We are not liable for any costs or consequences arising from incomplete or invalid documentation.
Documents We Provide: We will provide booking confirmation, detailed itinerary, and emergency contact information before your tour. Please review these carefully and contact us with any questions.
12. Privacy Policy

By booking a tour, you consent to the collection and use of your personal information as described in our Privacy Policy, including:
- Processing your booking and payments
- Communicating with you about your safari
- Sharing relevant information with service providers (lodges, parks, transport)
- Sending marketing communications (with your consent)
- Complying with legal obligations
13. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, droughts, volcanic eruptions)
- Epidemics, pandemics, or public health emergencies
- War, terrorism, civil unrest, or political instability
- Government actions, travel bans, or border closures
- Strikes, labor disputes, or industrial action
- Road closures, infrastructure failures, or transport disruptions
- Severe weather conditions affecting travel safety
- Fire, explosion, or other accidents
In the event of a force majeure occurrence, we will make reasonable efforts to modify your itinerary or reschedule your tour. If modification is not possible, we will offer a credit for future travel valid for 24 months from the original departure date.
We strongly recommend comprehensive travel insurance that covers cancellation due to force majeure events.
14. Dispute Resolution
Complaints: If you have a complaint during your safari, please inform your guide immediately so we can attempt to resolve the issue. Most problems can be resolved on the spot.
Written Complaints: If you are unable to resolve a complaint during your tour, you must submit a written complaint within 14 days of returning from your safari. Send complaints to info@sangareguidedsafari.com with your booking reference number.
Investigation: We will investigate your complaint and respond within 28 days. We may request additional information or documentation to support your claim.
Mediation: If a complaint cannot be resolved through direct discussion, either party may request mediation through an independent mediator agreed upon by both parties.
Governing Law: These Terms and Conditions are governed by the laws of the Republic of Kenya. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Kenya.
Limitation Period: Any legal action arising from or related to these Terms must be commenced within 12 months of the tour completion date.
15. General Provisions
Entire Agreement: These Terms and Conditions, together with your booking confirmation and itinerary, constitute the entire agreement between you and Sangare Guided Safari regarding your safari booking.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.
Assignment: You may not assign or transfer your booking without our prior written consent. We may assign our rights and obligations under these Terms to a successor entity.
Notices: All notices to us must be sent by email to info@sangareguidedsafari.com. We will send notices to the email address provided at the time of booking.
Amendments: These Terms and Conditions may be amended from time to time. The version in effect at the time of your booking will apply to your reservation.
Language: These Terms are drafted in the English language. In the event of any conflict between the English version and any translation, the English version shall prevail.
